From 1 May 2025 and every three months thereafter, the approved provider must submit to the Regulatory Authority its Quality Improvement Plans for any education and care services in NSW that are rated at Working Towards the National Quality Standard.
These plans must demonstrate progress towards addressing all quality areas rated as Working Towards.

From 1 May 2025 the approved provider must ensure that, in respect to each of its education and care services in NSW:
a. any allegations or incidents involving physical or sexual abuse of a child in education and care at its services; and
b. any circumstance arising at any of its services that poses a risk to the health, safety or wellbeing of child
are reported to the Regulatory Authority as soon as practicable, but not later than 24 hours, of the matter being reported to an educator, nominated supervisor, or area manager.

The approved provider must
a. prepare a compliance improvement plan and submit a copy of that plan to the Regulatory Authority by 9 May 2025.
b. Ensure that the compliance improvement plan addresses the following:
i. Adequate supervision of children, consistent with section 165 of the National Law.
ii. Taking reasonable precautions to protect children from harm or hazards, consistent with section 167 of the National Law.
iii. Ensuring certain information is notified to the Regulatory Authority within prescribed timeframes, consistent with section 174 of the National Law.
c. Ensure that the Compliance Improvement Plan contains, as a minimum, the following details:
i. relevant section/regulation;
i.planned compliance improvement actions;
ii. How the provider will monitor its own compliance and improvement actions;
iii. how the provider will ensure that parent complaints are appropriately addressed;
iii. improvement action taken;
iv. date of action taken; and
v. name and signature of person taking action.
d. Submit a copy of the compliance improvement plan to the Regulatory Authority on a quarterly basis commencing on 1 October 2025, with an update on progress.

The approved provider must notify all families of children enrolled at the education and care service of these conditions and provide a copy of this notification to the Regulatory Authority.

The approved provider must ensure the children in the temporary increase is accommodated in the first available vacancy. If the children have been placed in a vacancy or ceases to attend the service, the approved provider must notify the Regulatory Authority within 24 hours. If neither action occurs, the temporary increase will expire on 28 December 2025.

This service is approved to provide education and care to 90 children from birth up to and including over preschool age

The service is not approved to provide education and care to school children.

The approved provider must ensure that no scalable outdoor play equipment is placed close to the perimeter on level 1.

The Approved Provider must adhere to and display prominently with the service approval at the front entrance to the education and care services premise a copy of the Soil Management Plan  E2175.

The approved provider must ensure that no outdoor play equipment is placed closer than 1.9m to the perimeter fencing.

Within 3 months of approval being granted, the approved provider is required to make arrangements for an officer, from the relevant regional office, to attend a rehearsal of the emergency and evacuation procedures in accordance with regulation 97(3)(a) of the Education and Care Services National Regulations 2011.

The approved provider is required to make arrangements within 2 months of approval being granted with the relevant regional office to arrange attendance when the service will conduct a rehearsal of the emergency and evacuation procedures in accordance with regulation 97(3)(a) of the Education and Care Services National Regulations 2011.

The approved provider must take reasonable steps to ensure that the nominated supervisor and staff members of, and volunteers at, the service follow the policy and procedure Play Scape Design, Inclusion and Program.

A person must be present at the education and care service in accordance with regulation 134 who is actively working towards  an approved early childhood teacher qualification; and
	- has completed at least 50% of the course; or
	-  holds an approved diploma level education and care qualification.

A person who holds an approved diploma-level qualification/who is a suitably qualified person as determined by ACECQA may be taken to be an early childhood teacher for the purposes of regulation 134(1)(a). 

A person who holds a diploma-level qualification may be taken to be a suitably qualified person for the purposes of regulation 134(1)(b). 

The approved provider must engage with an Early Childhood Teacher for the purposes of developing and implementing the education program being delivered to children being educated and cared for at this service. 

The approved provider must take reasonable steps to recruit an early childhood teacher during the waiver period 

The approved provider must notify the Regulatory Authority within 14 days if the waiver is no longer required

This service is approved to provide education and care to children from birth to over preschool age, not including school children.

It is a condition of this service approval that the CCTV cameras and monitors installed at the service are consistently maintained and operational to ensure the facilitation of supervision of children at all times they are being educated and cared for at the service, having regard to the need to maintain the rights and dignity of the children as required under regulation 115 of the Education and Care Services National Regulations.

This service is approved to provide a rest period from 12:00pm to 2:00pm on Monday to Friday.

This service is approved to provide education and care to children from birth to preschool age, not including school children.

The Approved Provider must ensure that any climbable/moveable outdoor play equipment on levels above ground floor is not placed within 1.9m of the perimeter fencing.

The Approved Provider is required to ensure objects are not placed in a manner that may allow a child to climb over barriers or fences; and, all play equipment in the outdoor play spaces are maintained and placed in a way that meets the requirements of the Australian Playground Standards (Standard AS 4685:2014) with particular consideration given to falling space, impact areas and free space.

The approved provider must comply with the conditions of the Operational Soil Management Plan (OSMP)(AGS160138-M01) during site operation.

The approved provider is required to make arrangements within 3 months of approval being granted with the relevant regional office to arrange attendance when the service will conduct a rehearsal of the emergency and evacuation procedures in accordance with regulation 97(3)(a) of the Education and Care Services National Regulations 2011.

The approved provider must ensure that they incorporate and maintain natural elements and features within outdoor spaces.

It is a condition of this service approval that the mirrors installed at the service are maintained to ensure the facilitation of supervision of children at all times they are being educated and cared for at the service, having regard to the need to maintain the rights and dignity of the children as required under regulation 115 of the Education and Care Services National Regulations.

The service must have a policy in relation to the use of simulated outdoor play space.

The approved provider must take reasonable steps to ensure that the nominated supervisor and staff members of, and volunteers at, the service follow the policy and procedure.

The approved provider must ensure that no outdoor play equipment is placed no closer than 1.9m to the perimeter fencing.

The approved provider must notify the Regulatory Authority within 14 days of any changes to the supervision policy for the service.

The approved provider must take reasonable steps to ensure that the nominated supervisor and staff members of, and volunteers at, the service follow the supervision policy for the service.

The approved provider is required to make arrangements within 3 months of approval being granted with the relevant regional office to arrange attendance when the service will conduct a rehearsal of the emergency and evacuation procedures in ccordance with regulation 97(3)(a) of the Education and Care Services National Regulations 2011.

The approved provider must ensure that no outdoor play equipment is placed within 1.9m of the perimeter fencing.

The approved provider must develop a plan to ensure that all children being educated and cared for at the service have regular access to genuine outdoor space and natural environment and natural features. This plan must be submitted to the Regulatory Authority by 30 April 2018.

The waiver from regulation 108 – outdoor space only relates to the covered outdoor play area in Playscape 01 and Playscape 03 as denoted on the plans.

Playscape 02, as denoted on the plans, is not considered in the calculations for regulation 108 – outdoor space.

The Approved Provider must ensure that the Nominated Supervisor, staff and volunteers are aware of the risk assessment and follow the procedures for the adequate supervision of children using the outdoor space which contains the service entry gate.

The Approved Provider must ensure that objects are not placed in a manner that may allow a child to climb over barriers or fences, and all play equipment in the outdoor play spaces is maintained and placed to meet the requirements of the Australian Playground Standards (Standard AS 4685:2014) with particular consideration given to falling space, impact areas and free space.

The Approved Provider is required to make arrangements within 3 months of service approval being granted with the relevant regional office to arrange attendance when the service will conduct a rehearsal of the emergency and evacuation procedures in accordance with regulation 97(3)(a) of the Education and Care Services National Regulations 2011.

The service is approved to provide education and care to children from birth up to and including preschool age.

The mirrors and CCTV and monitors installed at the service are constantly maintained and operational to ensure the facilitation of supervision of children at all times they are being educated and cared for at the service, having regard to the need to maintain the rights and dignity of the children as required under regulation 115 of the Education and Care Services National Regulations.

A person who holds an approved diploma-level qualification/who is a suitably qualified person as determined by ACECQA may be taken to be an early childhood teacher for the purposes of regulation 133 

A person who holds a diploma-level qualification may be taken to be a suitably qualified person for the purposes of regulation 133 

The approved provider must engage with an Early Childhood Teacher for the purposes of developing and implementing the education program being delivered to children being educated and cared for at this service. 

The approved provider is encouraged to support current diploma staff to enrol into the Bachelor of Education 

The approved provider must take reasonable steps to recruit an early childhood teacher during the waiver period 

The approved provider must notify the Regulatory Authority within 14 days if the waiver is no longer required

•	    An approved provider of an education and care service that is listed on the Department of Education & Training Bushfire At-Risk Register must ensure that: 
•	The service does not operate on any day that the Victorian Emergency Management Commissioner declares as having a 'Catastrophic' Fire Danger Rating that applies to the area or district at which that service is located.
•	The service's emergency and evacuation policies and procedures required under regulation 168 of the Education and Care Services National Regulations include an Emergency Management Plan for managing the service's bushfire and grass fire related risks.
•	The service's Emergency Management Plan is kept up to date, reflects the service's operating context, is reviewed at least once each calendar year, and includes:
o	a list of the service's emergency contact details
o	procedures for monitoring and managing bushfire and grassfire risks and events
o	procedures for identifying and managing events that may cause planned, unplanned or pre-emptive closure of the service
o	procedures for notifying families of children enrolled at the service of any closure
o	procedures for reviewing and updating the Emergency Management Plan.
•	A copy of the service's Emergency Management Plan is made available to the Regulatory Authority on request.

This service is approved to provide education and care to children from birth up to and including over preschool age.

This service is not approved to provide education and care to school children.

The mirrors, CCTV and monitors installed at the service are constantly maintained and operational to ensure the facilitation of supervision of children at all times they are being educated and cared for at the service, having regard to the need to maintain the rights and dignity of the children as required under regulation 115 of the Education and Care Services National Regulations.

The approved provider may not provide an education and care service from the premises after 31 March 2026 without prior written approval from the Regulatory Authority.

The approved provider must ensure that the service approval for temporary relocation is surrendered on 31 March 2026 or prior to this date if it is no longer required.

This service approval is granted for the purpose of a temporary relocation to the premises located at 27 MUNDA ST, RANDWICK NSW 2031. The approval remains in force until and will expire on 31 March 2026 as per Development Consent provided by Randwick City Council dated 11 June 2025.

The approved provider must ensure at least one (1) additional educator, in addition to the number required to meet the educator-to-child ratios specified under regulation 123 of the Education and Care Services National Regulations, must be in attendance at all times whilst the service is operating.

The Approved Provider must ensure that enrolments for the three additional places are exclusively for children displaced from Only About Children Maroubra SE-40006922.

The approved provider must ensure that the education and care service only provides education and care for children over 18 months of age.

The approved provider must ensure that the education and care service does not conduct excursions to the fenced playground area to the east of the premises.

The approved provider must ensure that all risk assessments for regular outings and transitions are reviewed on a monthly basis. These must be available on request to the Regulatory Authority.

The approved provider must ensure that no more than 5 children under the age of 3; or 10 children aged between 3 and 5 attend the regular outing to the grassed area at Randwick Sustainability Hub at any one time.

The approved provider must ensure that no more than 5 children under the age of 3; or 10 children aged between 3 and 5 attend the regular outing to the Yarning Circle area at Randwick Sustainability Hub at any one time.

The approved provider must ensure that no more than 5 children under the age of 3; or 10 children aged between 3 and 5 attend the regular outing to the sustainability garden at Randwick Sustainability Hub at any one time.

The approved provider must notify the Regulatory Authority before recommencing education and care at Only About Children Maroubra, 106 Storey St, Maroubra, 2035.

This service is approved to provide education and care to children from birth up to and including preschool age, not including school children.

The approved provider must not provide education and care for more than four (4) non-ambulant infants at any one time.

The mirrors installed at the service are constantly maintained and operational to ensure the facilitation of adequate supervision of children at all times they are being educated and cared for at the service, having regard to the need to maintain the rights and dignity of the children as required under regulation 115 of the Education and Care Services National Regulations.

The approved provider must take reasonable steps to ensure that the nominated supervisor and staff members of, and volunteers at, the service follow  the policy and procedure.

The approved provider and nominated supervisor must ensure that the policy and procedure Oac Brighton East Campus Procedure for supervising restricted view bathroom is communicated to and followed by educators and staff at the service.

•     An approved provider of an education and care service that is listed on the Department of Education & Training Category 4 List – at some risk of bushfire or grassfire must ensure that: •	The service does not operate on any day that the Victorian Emergency Management Commissioner declares as having a 'Catastrophic' Fire Danger Rating that applies to the area or district at which that service is located.
