Conditions can follow a regulatory visit, a complaint or an incident.

Child Care Subsidy rates are changing soon. 

•	    An approved provider of an education and care service that is listed on the Department of Education & Training Bushfire At-Risk Register must ensure that: 
•	The service does not operate on any day that the Victorian Emergency Management Commissioner declares as having a 'Catastrophic' Fire Danger Rating that applies to the area or district at which that service is located.
•	The service's emergency and evacuation policies and procedures required under regulation 168 of the Education and Care Services National Regulations include an Emergency Management Plan for managing the service's bushfire and grass fire related risks.
•	The service's Emergency Management Plan is kept up to date, reflects the service's operating context, is reviewed at least once each calendar year, and includes:
o	a list of the service's emergency contact details
o	procedures for monitoring and managing bushfire and grassfire risks and events
o	procedures for identifying and managing events that may cause planned, unplanned or pre-emptive closure of the service
o	procedures for notifying families of children enrolled at the service of any closure
o	procedures for reviewing and updating the Emergency Management Plan.
•	A copy of the service's Emergency Management Plan is made available to the Regulatory Authority on request.

The approved provider is required to ensure a minimum of 2 educators engaged and working directly with children at all times, when the number of children enrolled and attending the education and care service exceeds 10.

The maximum number of family day care educators that may be engaged or registered by the approved provider is 25.

•  	The approved provider of a family day care education and care service must ensure that: 
•	Family day care educators engaged by or registered with the service and approved family day care venues, that are located in an area or district of bushfire or at risk of grassfire, close and do not operate on any day declared by the Victorian Emergency Management Commissioner to be a day of ‘Catastrophic’ Fire Danger Rating that applies to the area or district at which the family day care educator’s residence or family day care venue is located.
•	The family day care service’s emergency and evacuation policies and procedures required under regulation 168 of the Education and Care Services National Regulations include an Emergency Management Plan for managing the services’ and family day care educators’ bushfire and grassfire related risks.
•	The family day care service’s Emergency Management Plan reflects the operating context of the family day care service and its family day care educators, is kept up to date, reviewed at least once each calendar year; and includes:
o	 a list of the service’s emergency contact details
o	procedures for monitoring and managing bushfire risks and events
o	procedures for identifying and managing events that may cause planned, unplanned or pre-emptive closure of the service or family day care educators’ service
o	procedures for notifying families of children enrolled at the service of any closure
o	procedures for reviewing and updating the Emergency Management Plan.
•	The Emergency Management Plan is made available to the Regulatory Authority on request.

•     An approved provider of an education and care service that is listed on the Department of Education & Training Category 4 List – at some risk of bushfire or grassfire must ensure that: •	The service does not operate on any day that the Victorian Emergency Management Commissioner declares as having a 'Catastrophic' Fire Danger Rating that applies to the area or district at which that service is located.
•	The service's emergency and evacuation policies and procedures required under regulation 168 of the Education and Care Services National Regulations include an Emergency Management Plan for managing the service's bushfire and grass fire related risks.
•	The service's Emergency Management Plan is kept up to date, reflects the service's operating context, is reviewed at least once each calendar year, and includes:
o	a list of the service's emergency contact details
o	procedures for monitoring and managing bushfire and grassfire risks and events
o	procedures for identifying and managing events that may cause planned, unplanned or pre-emptive closure of the service
o	procedures for notifying families of children enrolled at the service of any closure
o	procedures for reviewing and updating the Emergency Management Plan.
•	A copy of the service's Emergency Management Plan is made available to the Regulatory Authority on request.

The waiver for regulation 123(1)(c) applies on a maximum of two days per week.

The approved provider must ensure that on the days the waiver is required, there is no more than one additional child specified in the waiver application attending the service, and a minimum of two educators actively working with a maximum of 23 children at all times.

The approved provider must ensure that no further enrolments are accepted by the education and care service, with the exception of the child specified in the waiver application whilst this waiver is in effect.

The approved provider must notify the Regulatory Authority within 14 days if the waiver is no longer required.

iii.	procedures for identifying and managing events that may cause planned, unplanned or pre-emptive closure of the service
iv.	procedures for notifying families of children enrolled at the service of any closure
v.	procedures for reviewing and updating the Emergency Management Plan.
e.	A copy of the service's Emergency Management Plan is made available to the Regulatory Authority on request.

The educator to child ratio for children aged 36 months of age to preschool age will be at least one educator to 13 children.

The approved provider must ensure that whenever children are being educated and cared for in room number 5 (as denoted on the plan), and as part of the funded kindergarten program, that an additional educator above the minimum prescribed in regulation 123(1) of the Education and Care Services National Regulations 2011 is available to support the supervision and transition of the kindergarten children to other areas of the service.

The approved provider must ensure there is at least one educator working directly with the children who holds, or is enrolled in and studying for, at least a qualification published under regulation 137(2) in the list of approved diploma level education and care qualifications.

The approved provider must take reasonable steps during the waiver period to recruit an educator who holds (or is enrolled in and studying towards) an approved diploma level education and care qualification which meets the Victorian requirements for working with children over preschool age].

The approved provider must notify the Regulatory Authority within 14 days if the waiver is no longer required.
The waiver applies on Tuesdays after 2.30pm and all-day Wednesday, when there is only on diploma level educator present at the service.

The approved provider must engage two educators and must not educate and care for more than 23 children aged 36 months of age to preschool age.
The approved provider must notify the Regulatory Authority within 14 days if the waiver is no longer required
The approved provider must take reasonable steps to meet the educator to child ratios during the waiver period where possible.

The maximum number of family day care educators that may be engaged or registered by the approved provider is 75.

An approved provider of an education and care service that is listed on the Department of Education Category 4 List – at some risk of bushfire or grassfire must ensure that: 

The service does not operate on any day that the Victorian Emergency Management Commissioner declares as having a 'Catastrophic' Fire Danger Rating that applies to the area or district at which that service is located.

No more than one nominated educator meeting the requirements of regulation 56 of the Children’s Services Regulations 1998 can be counted in the qualified educator to child ratios.

The waiver for regulation 123(1)(c) applies on a maximum of five days per fortnight.

The approved provider must ensure that on the days the waiver is required, there is no more than one additional child specified in the waiver application attending the service, and a minimum of two educators actively working with children at all times.

The approved provider must ensure that on the days the waiver is required, no further enrolments are accepted by the education and care service, with the exception of the child specified in the waiver application whilst this waiver is in effect.
